Driving After Suspension or Revocation
The penalties for driving after a suspension or revocation for driving under the influence are spelled out in Section 1543, subsection (b)(1) of the Pennsylvania code. For a first offense, the mandatory sentence is 60 days in jail. However, if you had a BAC of .02 percent at the time or greater at the time your arrest, the minimum sentence is 90 days. Individuals caught while driving after a DUI suspension a second time will spend a minimum of six months in prison. The third and any subsequent offenses carry a mandatory minimum of two years in prison.
